Whether it rings unconvincingly in our ears, surely the second does, and it is this which I shall address. The suppos1t1on that moral conventions depend on religious belief has become alien to our way of thinking. Hollis tells us “We cannot flourish without trust” and with this we surely must agree, following “John Locke [who] declared trust to be ‘the bond of society’”. In a “reliable social order,…people find it rational to trust one another”. Hollis’ question, and it is absolutely fundamental to debates between liberals and communitarians, or between rationalists and traditionalists, is whether reason sustains trust, and with trust social order, or whether reason undermines trust. Takes up the questions of the initial bargaining position and the initial factor endowment, raised in Chs. 6 and 4 respectively. We reject James Buchanan's identification of the initial bargaining position with the outcome of non‐cooperative interaction, and John Harsanyi's identification of it with the threat point. Instead, we argue that, as the basis of market and cooperative interaction, it must rule out all taking of advantage—bettering oneself through worsening the situation of others. We term this condition the ‘proviso’, deriving (...) it from Robert Nozick's interpretation of Locke's insistence that in acquisition, one leave ‘enough, and as good’ for others. We show how the proviso constrains directly maximizing behaviour, and we then demonstrate its role in introducing a structure of individual rights to person and property, rights that define each person's initial bargaining position and factor endowment. We show that the proviso satisfies our standard of impartiality, and why rational persons would accept the proviso, as part of a narrow interpretation of compliance with the requirements for cooperation. We show that cooperation in the absence of the proviso tends to be unstable, and to depend on ideologies, entrenched historical factors, and differential technologies, all of which undermine the equal rationality of persons on which an impartial morality depends. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Early-Modern Irish Catholics exiled on the European continent are known to have often held prominent academic positions in various important colleges and universities. This paper investigates the hitherto unknown Scholastic legacy of the Dublin-born Jesuit John Austin (1717–84), a famous Irish educator who started his career teaching philosophy at the Jesuit college of Rheims in 1746–47, before returning to the country of his birth as part of the Irish Mission. These manuscript lecture notes provides us first-hand knowledge about the content (...) of French Jesuit education in the middle of the eighteenth century, which does not correspond to its classical reputation of ‘Aristotelian’ scholasticism opposed to philosophical novelties. While stitching to a traditional way of teaching, Austin introduces positively elements from Descartes, Malebranche, Locke and Newton into the curriculum. The present paper focuses on his conception of philosophical certitude (certitudo), which he considered a necessary condition for the possibility of philosophical knowledge. (shrink)

The studies on the history of logic in the Polish schools of the Commission for National Education in the period of the Enlightenment that have been published up to date evaluate the educational practice with respect to its accordance to Condillac’s work. His textbook was indeed order by the Commission for its schools, and it was also evaluated highly, but it was not published in the Polish language. From the rules of the Commission and its didactic practice, which made use (...) of a series of the most eminent eclectic textbooks on logic then functioning in the European school, we can deduce that the Commission must have evaluated Condillac’s book as too one-sided. Aside to his approach, there functioned in then Polish school a number of other studies. The Commission exposed a textbook written by the French Jesuit, Claude Buffier, in the first place. Despite the fact that he was close to modern solutions, e.g. Descartes’ and Locke’s, nevertheless he showed respect for scholastic tradition. Accordingly, he presented a group of solutions well-known from the traditional approaches. He only emphasised, in the modern spirit, how important is the veracity of the premises of syllogism as the fundamental condition for the veracity of the conclusion. It follows that the role of the theory of reasoning was limited and at the same time the value of epistemological problems was stressed. (shrink)

The present article looks to the contractarian tradition of (...) Hobbes and Locke—as reinterpreted by David Gauthier, Robert Nozick, and John Rawls—for an alternative justification for international bioethics. Drawing on the central themes of this tradition, it is argued that international bioethics can be rationally reconstructed as a negotiated moral order that respects culturally and individually defined areas of nonnegotiability. The alienation of body parts and their transformation into commodities raises questions about ownership, property rights, and about possible violation of the moral order. This article focuses on the `social life' of objects, including body parts, and the multiple meanings attached to them that are made visible in systems of exchange. The transformation of DNA obtained in blood samples into immortalized cell lines for use in the Human Genome Diversity Project is introduced as an illustration of contested commodification. The aim of this article is to discuss quantitative content analysis as established in communication sciences as a method for research in business ethics. We argue that communication sciences and business ethics are neighboring disciplines, which allow the transfer of quantitative content analysis from communication sciences to business ethics. Technically, quantitative content analysis can be applied through human as well as software coding. Examples for both applications are provided and discussed. We make reference to the software solutions ‘Leximancer’, ‘Crawdad’, and (...) ‘Wordle’, and examine their suitability and limitations with regard to ethical questions for researching business ethics. We recommend a mixed‐method approach, combining human and software coding. Furthermore, we propose a three‐step process that discusses quantitative content analysis as a method for business ethics, including an ethical research objective, and most importantly, concluding with ethical reasoning and interpretation of the quantitative results. Foremost among the principles was one stating that morally permissible human experiments require the informed voluntary consent of the subject. The Nuremberg judgment soon became associated with the ideal of human rights declared in the 1948 United Nations Charter. These two ideas—fundamental principles of morality and human rights—have been linked in all major formulations of international bioethics promulgated in the past 50 years, including the Council of Europe’s 1997 Convention for the Protection of Human Rights and Dignity of the Human Being with Regard to the Application of Biology and Biomedicine (Council of Europe 1997; Dommel and Alexander 1997). Hume is rightly credited with giving a brilliant, and perhaps the best, account of justice as convention. Hume's importance as a forerunner of modern economics has also long been recognized. However, most of Hume's readers have not fully appreciated how closely Hume's analysis of convention foreshadows a particular branch of economic theory, namely, game theory. Starting with the work of Barry, Runciman and Sen and Lewis, there has been a flowering of literature on the informal game-theoretic insights to be found (...) in classics of political philosophy such as Hobbes, Locke, Hume and Rousseau. A number of authors in this tradition, including Lewis, Gauthier, Mackie, and Postema, have identified passages in Hume which they interpret as giving informal examples of specific games. Yet, unlike his predecessors, Hobbes and Locke, Hume does much more than present examples which have a game-theoretic structure. In his account of convention, Hume gives general conditions which characterize the resolution of social interaction problems, and in the examples he uses to illustrate this account, Hume outlines several different methods by which agents can arrive at such a resolution. Hume's general account of convention and his explanations of the origins of particular conventions together constitute a theory of strategic interaction, which is precisely what game theory aspires to be. Addressing the critique that communication activities with regard to CSR are often merely instrumental marketing or public relation tools, this paper develops a toolbox of CSR communication that takes into account a deliberative notion. We derive this toolbox classification from the political approach of CSR that is based on Habermasian discourse ethics and show that it has a communicative core. Therefore, we embed CSR communication within political CSR theory and extend it by Habermasian communication theory, particularly the four validity claims (...) of communication. Given this communicative basis, we localize CSR communication as a main means to receive moral legitimacy within political CSR theory. A typology of CSR communication tools is advanced and substantiated by a review of case studies supporting the categories. Thus, we differentiate between instrumental and deliberative, as well as published and unpublished tools. Practical examples for the literature-derived tool categories are provided and their limitations are discussed. (shrink)

Discourse in EuroAmerica in connection with menopause is selectively naturalized, with specific consequences for practice, deflecting attention away from non-biological aspects of ageing. The medicalized discourse of North America is compared with that of contemporary Japan, where emphasis is focused predominantly on social rather than biological change. Following Latour and Haraway, it is argued that culture and nature are not dichotomous. Further, both biology and culture are contingent. `Local biologies', that is, subjective experience constituted from culturally informed knowledge, expectations and (...) practices, are in part shaped by physical sensations and symptoms, that differ quantitatively in Japan and North America. This difference influences - but does not determine - the production of discourse and medical responses to this stage of the life cycle. Situated cultural practices of creating culture/nature boundaries are sites for moral and political disputes, which in turn influence subjective experience, the discourse of medicalization and the politics of ageing. As genetic tests become cheaper and more readily available, pressure is increasing to routinely test individuals for susceptibility genes for complex common disorders. Using Alzheimer’s disease as an illustrative example, it is shown how population databases of AD cases on which individual risk estimates are based are faulty due to confusion about the AD phenotype. Furthermore, the APOEe4 genotype associated with increased risk of AD is neither necessary nor sufficient to cause AD. Richard Cumberland, the Anglican divine, concludes his anti-Hobbesian work, Treatise of the Laws of Nature, with the following remarkable observation: ‘Hobbes, whilst he pretends with one hand to bestow gifts upon princes, does with the other treacherously strike a dagger to their hearts.’ This remark sums up a dominant theme of seventeenth-century reactions to Hobbes's political theory; a host of similar complaints could be marshalled from among the ranks of secondary figures such as Clarendon, Filmer and Pufendorf. Today, however, Cumberland's (...) criticism has a relatively unfamiliar ring. Following the lead famously given by John Locke, we are much more likely to be impressed by the totalitarian features of Hobbes's political philosophy than by its subversive character. To preclude initial objections, there is of course a relatively uncontroversial sense in which Hobbes's thought is subversive; in metaphysics, ethics and theology Hobbes's daggers are deliberately aimed at the hearts of the Schoolmen and the Puritans. But Cumberland's concern in the quotation is with Hobbes's theory of sovereignty: the thrust of his criticism is that the theory is top-heavy, and this issue has not received much attention in recent years. One notable exception is David Gauthier who writes that ‘from unlimited individualism only anarchy follows. The theory is a failure.’ Gauthier, however, argues tht Hobbes's presentation of his theory in Leviathan marks a major advance over the earlier De Cive, and if our criterion of success is the strength of the sovereign's position, then this claim seems highly suspect. In the first part of this paper I shall argue that the sovereign of Leviathan is a more vulnerable figure than the sovereign of the earlier De Cive. In the second part of the paper I take up the problem posed by military service for a Hobbesian theory of political obligation. Employing a distinction between act- and rule-prudentialism, I shall argue that here again the position of Leviathan is in some ways less satisfactory than that of the earlier works. (shrink)

The call for 'triage' as a specific policy for the selection of patients presenting with chronic renal failure, in the light of increasingly limited resources prompted us to question nephrologist on their bases for selection. We discovered no absolute criteria for rejection, but a consensus of opinion against those with additional and complicating factors to their renal disease such as age, hepatitis carriers and mental illness-a bias seen throughout the National Health Service. In this paper we discuss the validity of (...) such criteria, the implications of the currently pragmatic and often covert practice of selection, and in this potentially finite area of demand we question the rationale for the limitation of resources. The supposition of the manifest covariance of average trajectory world lines is violated in Hamiltonian formulations of relativistic quantum mechanics. This is due to the nonlinear appearance of particle dynamical variable operators in the Heisenberg picture boosted position, velocity, and momentum operators. The magnitude of this deviation from world line manifest covariance is found to be exceedingly small for a number of common time of flight experiments.

Techniques for constructing the tensor product of two generalized sample spaces which admit unital sets of dispersion-free weights are discussed. A duality theory is developed, based on the 1-cuts of the dispersion-free weights, and used to produce a candidate for the tensor product. This construction is verified for Dacification manuals, a conjecture is given for other reflexive cases, and some adjustments for nonreflexive cases are considered. An alternate approach, using graphs of interpretation morphisms on the duals, is also presented.

Edmund Burke was one of the most profound, versatile, and accomplished thinkers of the eighteenth century. Born and educated in Dublin, he moved to London to study law, but remained to make a career in English politics, completing A Philosophical Enquiry into the Origin of Our Ideas of the Sublime and Beautiful before entering the political arena. A Member of Parliament for nearly thirty years, his speeches are still read and studied as classics of political thought, and through his best-known (...) work, Reflections on the Revolution in France he has continued to exercise a posthumous influence as `the father of conservatism'. This is the first full, scholarly biography of Burke for over a generation, to be completed in two volumes. The first volume covers the years between 1730-1784, and describes his Irish upbringing and education, early writing, and his parliamentary career throughout the momentous years of the American War of Independence. Lavishly illustrated, it provides an authoritative account of the complexity and breadth of Burke's philosophical and political writing and examines its origins in his personal experiences and the political world of his day. The issue of detention as a tuberculosis control measure has resurfaced following the prolonged detention of a patient with an extensively drug-resistant strain of tuberculosis in a prison cell in Arizona, and the attempted detention in Italy and subsequent detention in Atlanta, Georgia of an American sufferer thought to have XDR-TB in May 2007. These cases have reignited the debate over the evidence that supports detention policy in the control of tuberculosis, and its associated legal and ethical ramifications. This paper (...) considers whether involuntary detention is justified where voluntary measures have failed or where a patient poses a danger, albeit uncertain, to the public, and discusses the need for strengthening evidencebased assessments of public health risk. In this paper, I develop the notion of an epistemic side constraint in order to overcome one of the main challenges to a goal-based approach to the structure of epistemic normativity. I argue that the rationale for such side constraints can be found in the work of John Locke and that his argument is best understood as the epistemic analog to David Gauthier’s argument as to the rationality of being moral.

Social attention is thought to require detecting the eyes of others and following their gaze. To be effective, observers must also be able to infer the person's thoughts and feelings about what he or she is looking at, but this has only rarely been investigated in laboratory studies. In this study, participants' eye movements were recorded while they chose which of four patterns they preferred. New observers were subsequently able to reliably guess the preference response by watching a replay of (...) the fixations. Moreover, when asked to mislead the person guessing, participants changed their looking behavior and guessing success was reduced. In a second experiment, naïve participants could also guess the preference of the original observers but were unable to identify trials which were lies. These results confirm that people can spontaneously use the gaze of others to infer their judgments, but also that these inferences are open to deception. (shrink)

Adults have been shown to attribute certain properties more frequently than others to the dead. This category-specific pattern has been interpreted in terms of simulation constraints, whereby it may be harder to imagine the absence of some states than others. Afterlife beliefs have also shown context-sensitivity, suggesting that environmental exposure to different types of information might influence adults? reasoning about post-death states. We sought to clarify category and context effects in adults afterlife reasoning. Participants read a story describing the death (...) of a human protagonist after exposure to a biological prime, an emotional prime, or no prime. Emotions, desires, and epistemic states were more frequently attributed to the dead character than biological, psychobiological, and perceptual states, partially replicating previous findings. The biological prime decreased the attribution of certain post-death states relative to the control condition, whereas the emotional prime had no effect. Simulation theory does not provide a satisfactory explanation of the present findings, which may be better accounted for by conflict between different cognitive systems that are engaged in thinking about the dead. Tal percurso de leitura, nesse viés, incorpora os debates sobre performance, cena e representação, além de explorar o humor de minoria contestador que a obra revela como potência de ação (...) no mundo. The development of the Universal Declaration of Ethical Principles for Psychologists has sparked debate about its applicability to cultural groups around the globe. Focusing on the principle of respect espoused in the Declaration, this article uses examples largely drawn from the indigenous Ma-ori culture of Aotearoa/New Zealand, to highlight how the ethical imperatives espoused by the Declaration may conflict with the perspectives of M?ori. A discussion of actions denoting respect is given from a M?ori perspective. Buffier, SJ (1661–1737) emerged as one of the most influential of the Parisian scriptores librorumin the first decades of the eighteenth century. Buffier is (...) perhaps best known as one of the founding editors of, and contributors to, the influential French Jesuit periodical Mémoires de Trévoux, but his works on general grammar, metaphysics, moral philosophy, and logic earned him widespread renown. His Grammaire françaiseachieved translation into Spanish, German, Italian, and English, and his Cours de sciences sur des principes nouveaux et simples pour former le langage, l'esprit, et le cœur dans l'usage ordinaire de la vie(1715) was widely adopted in France and Spain throughout the eighteenth century. Buffier's eclectic approach to philosophy, science, moral philosophy, and practical theology developed across several significant works: Principes du raisonnement(1714), Traité des premières vérités(1724), Éléments de métaphysique(1725), and Exposition des preuves les plus sensibles de la véritable religion(1732). In these works, Buffier was prescient in selectively adopting perspectives from Descartes, Malebranche, and Locke, evincing thereby his avid interest and participation in early Enlightenment discussions. Many of Buffier's texts proved to be influential on contributors to the Encyclopédie, on Voltaire, and perhaps later, as harbingers of Scottish Common Sense philosophy. Given the growing recognition of Buffier's importance thanks to the work of Kathleen Wilkins, Catherine Northeast, Jeffrey Burson, Katharine Hammerton, and others, Louis Rouquayrol's new critical edition of Buffier's most influential work, Traité des premières vérités( Treatise of First Truths) is most welcome. Rouquayrol's critical edition of the Traitéis replete with helpful [End Page 156]intertextual explanatory notes to the texts and debates that Buffier addressed, and it includes an insightful synthetic introduction, which summarizes the Traitéand addresses aspects of its philosophical and historical significance. The editor also helpfully includes a detailed chronology of Buffier's life and works, a note about the textual bases for the edition, several instructive appendices to later editions and related works by Buffier, and a profoundly helpful bibliography that includes existing editions, copies, and translations of the Traité, in addition to scholarly studies of Buffier's life and work. Rouquayrol's critical edition is, in short, the best one currently available, and it is likely to remain the standard published edition for some time.In the editor's view, Buffier's primary significance is as the inaugural eighteenth-century figure who attempted to redress the weaknesses at the heart of Cartesian "innate ideas" in ways that might have avoided Berkeley's or Malebranche's immaterialism or Hume's skepticism: "pour lutter contre les 'conséquences idéalistes du cartésianisme,'" Buffier "avait eu plutôt recours au sens commun comme à un 'complément nécessaire du sense intime, qui garantit l'existence du monde extérieur'" (13n2, quoting Étienne Gilson). This "solution mitigée" allowed for a certain reconciliation between Descartes and the "empirisme tempéré" of Locke, and more broadly, a way of moderating "les principes des Modernes" with "les poncifs des Anciens" (13). This conciliation of Lockean empiricism and certain strands of Cartesianism found in Buffier was in fact a central point made by my earlier work on Buffier's contribution to eighteenth-century Enlightenment Catholicism (see Rise and Fall of Theological Enlightenment[South Bend, IN: University of Notre Dame Press, 2010]; also "Claude G. Buffier and the Maturation of the Jesuit Synthesis in the Age of Enlightenment," Intellectual History Review21 [2011]: 449–72). Rouquayrol's effort to revisit the complexities of this conciliation in his introduction is a welcome development. He explicitly reminds us that while Jesuits such as Buffier were prohibited from teaching particular theses associated with Descartes after 1706, they were nevertheless increasingly influenced by aspects of Cartesianism (15–17). This paper argues that Plato’s version of the contractarian theory of justice is superior to all other statements of that theory. The conditions any adequate theory of justice must meet are outlined and it is shown how contractarian theories attempt to meet these conditions. The great contractarian theories---those of Hobbes, Rousseau, Locke, Rawls, and Gauthier---are shown not to provide an adequate account of the nature of justice. The source of these failures is identified and, finally, it is shown that (...) Plato’s version of contractarianism is immune to this sort of failure. (shrink)

To sell a new drug, pharmaceutical companies must discover a compound, run clinical trials to test its efficacy and safety, get it approved by regulatory bodies, produce the drug, and market it. As this process brings the drug through so many hands, there are risks of many kinds of corruption. The pharmaceutical industry has recently gone from being one of the most admired industries to being described by the majority of Americans as “dishonest, unethical, and more concerned with profits than (...) with individual and public health.” Legal scholar Marc Rodwin suggested that the pharmaceutical industry can be viewed through the lens of institutional corruption as defined by legal scholar Lawrence Lessig, whereby widespread or systemic practices undermine the main purposes of drug therapy — healing illness, preventing medical problems, and alleviating suffering. Many drugs do serve these goals, yet a significant number of drugs churned out by pharmaceutical companies are ineffective or have dangerous side effects that could have been predicted had the companies conducted the appropriate research. Causal reasoning is an aspect of learning, reasoning, and decision-making that involves the cognitive ability to discover relationships between causal relata, learn and understand these causal relationships, and make use of this causal knowledge in prediction, explanation, decision-making, and reasoning in terms of counterfactuals. Can we fully automate causal reasoning? One might feel inclined, on the basis of certain groundbreaking advances in causal epistemology, to reply in the affirmative. The aim of this paper is to demonstrate that one still has (...) good skeptical grounds for resisting any conclusions in favour of the automation of causal reasoning. If by causal reasoning is meant the entirety of the process through which we discover causal relationships and make use of this knowledge in prediction, explanation, decision-making, and reasoning in terms of counterfactuals, then one relies besides on tacit knowledge, as might be constituted by or derived from the epistemic faculty virtues and abilities of the causal reasoner, the value systems and character traits of the causal reasoner, the implicit knowledge base available to the causal reasoner, and the habits that sustain our causal reasoning practices. While certain aspects of causal reasoning may be axiomatized and formalized and algorithms may be implemented to approximate causal reasoning, one has to remain skeptical about whether causal reasoning may be fully automated.
